Children in Israeli Military Detention: Observations and Recommendations

This paper is a result of UNICEF’s review of practices related to children who come into contact with the military detention system of Israel, from apprehension, to court proceedings and outcomes. The review investigated whether or not the military detention system conformed with the Convention on the Rights of the Child as well as the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment. While doing so, the structure and operation of the Israeli military detention system, legal framework, establishment of a juvenile military court, age of criminal responsibility and penalties under military law are presented and explored.

The review reveals how the ill-treatment of children who come into contact with the military detention system is widespread, systematic and institutionalized – from arrest to sentencing. 38 specific recommendations are provided on how the system can be improved to meet international laws, norms and standards.
