Save the Children warns about serious deficiencies in the Spanish judicial system – assessed against the standards dictated by international human rights law – and its ineffective responses to child sexual abuse cases, especially when very young children are involved and the abuse occurs within the family. The aim of this report is to present the findings of the analysis of four cases involving pre-school boys and girls who displayed early warning signs of being or having been sexually abused by a parent and whose cases were temporarily dismissed based on a court rule. The report identifies the main obstacles impeding sexually abused minors the right of access to effective judicial protection and adequate assistance and sets out some recommendations for public authorities as to the actions to be taken to address the special support and treatment needs of victims of parental child sexual abuse.
